Terms and Conditions
Introduction
These Terms and Conditions govern the hire of event items and event styling services (the "Services") provided by MKT Party Hire & Event Styling ("we," "us," "our"). By placing an order with us, you ("the Customer") agree to be bound by these Terms and Conditions.
Definitions
"Event" refers to the event or function for which the hire items or event styling services are booked.
"Hire Items" refers to any products, equipment, or supplies rented by the Customer from us.
“Display/set up” refers to any styling service provide by us.
"Hire Period" refers to the period during which the Hire Items are rented, as agreed upon between the Customer and us.
Booking Process
All bookings must be made through written form and confirmed by us. Once arrangements are agreed, a invoice will be issued detailing the arrangements.
A booking is considered confirmed once a deposit is received. By paying the invoice you are agreeing all details recorded on the invoice are true and correct.
Hire & Event Styling Fees and Payment
The Customer agrees to pay the total amount as specified in the invoice issued by us.
Payment terms are as follows: A $100 non-refundable deposit is required within 3 days of when the invoice is issued to secure a booking, with the remaining balance due at least 14 days prior the event. If the value of the booking is a value of $100 or less, full payment is required and if already inside 14 days of event full payment is required to secure booking.
Any late payments may result in cancellation of booking where no refund is applicable.
All prices are quoted in New Zealand Dollars and includes GST unless stated otherwise.
Custom Items
Where custom items are agreed, made or ordered, full payment is required immediately and non-refundable. This item will then become property of the hirer/purchaser after the event completion or in case of cancellation. These items will be specified on your invoice.
Bond
A refundable bond may be applicable with some hire items. This will be advised during the booking process and will be detailed on your invoice. The amount is due when making your final payment for the booking. Any damages or loss of items will be charged at the current replacement value and will be deducted from your bond. Should any breakages or loss of items exceed the cost of the Bond, you will be invoiced at the current value. This amount is due immediately. Your bond will be retained until all items have been returned, checked and verified. Any refund will be processed within 7 days of the return of items to us.
MKT Delivery, Setup, and Collection
Delivery of hire items will be made to the location confirmed in the Customer’s booking details.
The Customer is responsible for ensuring the delivery and collection area is safe, clear, and easily accessible.
Where setup is included, the Customer must ensure the designated area is prepared and cleared prior to our arrival to allow for efficient setup.
Collection of hire items will take place at the agreed time and location. All items must be secured, accessible, and ready for collection at this time.
Customer collection/return
We have a designated self service MKT Locker, located in Kinmont, Mosgiel where pick up and returns are available 7 days per week within the hours of 9am - 4pm unless otherwise agreed in writing. In the days leading up to pick up and/or return, you will receive further instructions and be provided your own unique pin code. Please ensure this is used even if there is another customer collecting at the same time as this will lodge your access of pick up and/or return in the system for security purposes.
Cancellations and Changes
If the Customer wishes to cancel the booking, they must notify us in writing.
Cancellations made 15 days or more before the event will receive a refund less the non-refundable deposit and any other items specified as per invoice, eg custom order/builds.
Cancellations made within 14 days of the event will not receive a refund.
Changes to the booking (e.g., additional items, time, or location) must advised as early as possible and may be subject to availability and additional charges.
Customer Responsibilities
The Customer must ensure the Hire Items are used safely and responsibly and are not damaged or misused.
The Customer is responsible for the security and safekeeping of the Hire Items during the Hire Period.
Any loss or damage to Hire Items will be charged to the Customer at the full replacement cost, including any associated delivery or repair charges.
Items must not be left outside overnight or in rain.
Damaged or Missing Items
The Customer must report any damages or missing items immediately upon delivery or setup.
If any Hire Items are returned damaged, lost, or missing, the Customer agrees to cover the costs for repair, replacement, or loss as determined by us.
Issues & Notifications
Any issues, concerns, or faults relating to hire items, setup, or services must be reported to MKT Party Hire immediately upon delivery, setup, or during the event.
This allows MKT Party Hire the opportunity to assess, rectify, or resolve the issue where possible.
Any issues reported after the event or after collection will not be accepted or considered, and no refunds, credits, or adjustments will be provided under any circumstances.
Force Majeure
We shall not be liable for any failure or delay in performance due to events outside our reasonable control, including but not limited to natural disasters, strikes, transport issues, or any unforeseen circumstance.
Liability
Our liability to the Customer is limited to the amount paid by the Customer for the Hire Items and Services as specified per the invoice.
We shall not be liable for any indirect, consequential, or incidental damages resulting from the use of the Hire Items.
Indemnity
The Customer agrees to indemnify and hold us harmless from any liability, losses, damages, or claims arising out of the use of the Hire Items during the Hire Period.
Privacy and Data Protection
We respect our customers' privacy and will only use personal data when necessary to contact you or to work with agencies involved in the repossession of our property.
Photography & Promotion
MKT Party Hire may take photographs of setups for marketing and promotional purposes unless the Customer requests otherwise in writing prior to the event.
Amendments to Terms and Conditions
We reserve the right to amend these Terms and Conditions at any time. Any amendments will be effective immediately upon publication on our website or notification to the Customer.
Acceptance of Terms
By placing a booking, receiving an invoice and making payment, the Customer acknowledges they have read, understood, and agreed to these Terms & Conditions.
